1. Acceptance of Terms

By using this website or the HappyTyping software, you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree to these Terms, you must not use the software or website.

2. Software License

When you purchase or lawfully obtain HappyTyping, you receive a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the software for personal or educational use, subject to these Terms.

• The license is granted only to the user who purchased or lawfully obtained the software.
• You may install the software on your own devices for your personal use.
• You may not resell, rent, lease, sublicense, redistribute, or share the software with others.
• You may not provide public access to the software as a hosted or shared service unless we expressly allow it in writing.
• We reserve the right to suspend or revoke licenses obtained through fraud, abuse, chargebacks, or other unauthorized conduct.

3. Acceptable Use

You agree to use the software and website only in a lawful and responsible manner.

• Do not reverse engineer, decompile, disassemble, or attempt to extract the source code, except where applicable law expressly permits it.
• Do not modify, tamper with, or bypass licensing or security features.
• Do not distribute pirated, unauthorized, or altered copies of the software.
• Do not use the software or website for unlawful, fraudulent, harmful, or abusive activities.

HappyTyping may allow you to import, type, store, or use your own text, articles, or learning content. You retain ownership of content that you create or lawfully provide.

• You are solely responsible for the content you import, store, or use in the software.
• You must not upload, import, or use content that infringes copyright, privacy, or other rights of others.
• You must not use unlawful, abusive, defamatory, or otherwise harmful content in connection with the software.

5. Intellectual Property

The software, website, branding, logos, design, text, graphics, and related materials are owned by HAPPY DEVELOPMENT SOFTWARE INC. or its licensors and are protected by applicable intellectual property laws.

Except for the limited license granted in these Terms, no ownership rights are transferred to you.

We may release updates, improvements, patches, fixes, or new features from time to time. Some updates may be necessary for security, functionality, compatibility, or product improvement.

We do not guarantee that any specific feature, update, or future version will always be available.

7. Text-to-Speech Features

HappyTyping may include text-to-speech or read-aloud features that depend on your device, operating system, installed voices, language settings, internet status, or third-party platform support.

We do not guarantee the availability, quality, or compatibility of any particular voice, language, or speech feature on every device.

To the fullest extent permitted by law, HAPPY DEVELOPMENT SOFTWARE INC. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, business, revenue, profits, goodwill, or other intangible losses arising out of or related to the use of, or inability to use, the software or website.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the software, website, or these Terms will not exceed the amount you paid for the software giving rise to the claim.

10. Termination

We may suspend, restrict, or terminate your license or access if you violate these Terms, misuse the software, engage in fraud or abuse, or use the software in a manner that could harm us or others.

Upon termination, you must stop using the software and delete all copies in your possession or control, unless applicable law requires otherwise.

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles.

If a dispute arises, it will be subject to the courts of British Columbia, Canada, unless applicable consumer protection law requires otherwise.
